Elder Law
Elder law relates to the representation and counseling of seniors and persons with disabilities with a variety of legal issues. Some examples of elder law issues we handle are:
- Medicaid Eligibility Review, Applications, & Appeals of Denials: The attorneys at the Law Office of Jonathan A. Hall, PLLC can help navigate you and your family through determining whether Medicaid is an option to pay for your long-term care, assist in the application process, and vigorously advocate for you on appeal.
- Veteran’s Benefits: Veterans whom have served during certain wartime periods and their widows may qualify for a benefit to help assist in paying their long-term care costs. In this context we are referring specifically to a pension benefit which reimburses a veteran or surviving spouse for recurring medical expenses which exceed their income and NOT to benefits payable due to a service-connected disability. You will sometimes hear this benefit referred to as Improved Pension or Aid & Attendance.
Jonathan will help navigate the benefits process by evaluating your eligibility, utilizing legal tools and strategies to ensure eligibility, and prepare and file applications on your behalf.
Attorney Jonathan A. Hall is accredited by the VA to assist in the preparation, presentation, and prosecution of a claim for VA benefits. If you have any questions about whether you or a loved one qualifies for assistance please contact Jonathan today for a complimentary initial consultation.
- Nursing Home Crisis Planning: When a loved one is about to enter or has already entered the nursing home you become very aware of the heavy financial burden. Many people have a mistaken belief their health insurance or Medicare covers skilled nursing care; in most cases these insurances do not cover an extended stay. In 2015, if you desire a private room in Lexington, Kentucky, the average annual cost for nursing care exceeds $95,000. There are a number of nursing homes throughout Indiana and Kentucky which charge in excess of $10,000 per month. Needless to say a life savings can be depleted very quickly. Medicaid, however, will cover custodial nursing home care.
When faced with such a situation it is important to consult with a competent elder law attorney to review Medicaid eligibility and assess what legal actions can be taken to protect your loved one’s assets. Delaying even a month can cost thousands; call today.
- Special Needs Trusts and Planning: Special needs trusts are designed to allow a person to receive money or property without jeopardizing that person’s ability to receive means-tested government benefits. For a child with a developmental or other disability, this planning is necessary to preserve their eligibility for Medicaid and SSI benefits. Without proper planning any inheritance or gifts received may be required to be spent or jeopardize continued eligibility.
